Monocle - End User License Agreement (EULA)

Please read this agreement carefully before downloading, installing, or using Monocle. By using the software, you agree to the terms of this End User License Agreement ("Agreement").

1. License Grant

Dominik Kandravý ("Developer") grants you a limited, non-exclusive, non-transferable license to install and use Monocle according to your purchased license tier:

Single License: use on 1 Mac by 1 user

Multi License: use on up to 3 Macs, whether by one user or multiple users within the same household or organization

2. Restrictions

You may not:

Copy, redistribute, resell, sublicense, rent, or lease the software

Reverse engineer, decompile, modify, or attempt to derive the source code of the software

Use the software on more devices than permitted by your license

Share, publish, or distribute license keys or activation credentials

3. Ownership

Monocle and all related intellectual property rights remain the exclusive property of the Developer. This Agreement grants you a license to use the software and does not transfer ownership of the software to you.

4. Updates

The Developer may provide updates, bug fixes, modifications, or feature changes at any time and at the Developer's sole discretion. Updates may be delivered automatically through Sparkle auto-update functionality. All updates are included with a valid paid license at no additional cost.

5. Disclaimer of Warranty

Monocle is provided "as is" and "as available," without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. The Developer does not guarantee that the software will be error-free, secure, or uninterrupted.

6. Limitation of Liability

To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or business interruption, arising out of or related to the use or inability to use Monocle.

In no event shall the Developer's total liability exceed the amount paid by you for the software license.

7. Termination

This license remains effective until terminated. The Agreement will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the software and uninstall all copies of Monocle.

Sections relating to ownership, warranty disclaimers, and limitation of liability shall survive termination.

8. Privacy and Connectivity

Monocle connects to Gumroad servers for license validation and to the Developer's servers (heyiam.dk) to check for and deliver software updates. The Developer does not use Monocle to collect analytics or tracking data. License validation is handled through Gumroad's platform and is subject to their privacy policy.

9. Governing Law

This Agreement is governed by the laws of the Czech Republic, without regard to conflict of law principles.
